Intellectual Property Department will coordinate the service and liaise with the applicant by phone/fax/email within 7 working days upon receipt of the completed application form. All fields must be completed.

The Free Intellectual Property Consultation Service is for SMEs only. Requests from law firms and providers of IP consultancy or other professional services will not be entertained.

(Certain types of IP, such as trade marks, designs and patents, have to be registered in order to obtain effective protection in the territory of registration.)

(It refers to a process such as the identification, acquisition, maintenance, protection, commercialization and/or enforcement of intellectual property rights. Such process may involve formulating an IP strategy, and integration of such strategy into the overall business strategy.)

(It means the process under which an IP owner grants the right to use an IP to another party on agreed terms and conditions.)

On behalf of myself, my company and/or my partners, I hereby acknowledge and agree that:

  • The analysis and/or suggestion which the Advisor may provide during the consultation session shall be based on the limited information provided by me for the purpose of the Free Intellectual Property Consultation Service. Neither the Advisor, the Government nor any of their employees (a) represents or warrants the accuracy or completeness of any analysis and/or suggestion provided by the Advisor pursuant to the Free Intellectual Property Consultation Service; (b) shall in any circumstances whatsoever be liable or responsible to me, my partners or my company for any inaccuracies, omissions, mistakes or errors in such analysis and/or suggestion or for any loss or damage (including without limitation any loss of profits, business contracts or revenues) arising therefrom and/or in connection therewith. The analysis and/or suggestion provided by the Advisor is only intended for broad guidance and shall not be construed as a substitute for formal legal service.
  • IPD is the coordinator of the Free Intellectual Property Consultation Service and it does not act as an agent or in any other capacity on my behalf or on behalf of the Advisor. Upon acceptance of my appointment request, IPD will arrange an Advisor to take up a free consultation session with me. I understand that IPD has not independently verified the work experience and expertise stated by the Advisor. The analysis and/or suggestion which the Advisor may provide during the consultation session shall not represent the views of IPD or the Government.
  • I undertake to notify IPD in writing at least 3 working days before the consultation session if I wish to cancel or reschedule the appointment. Late attendance/ absence without prior written notification/ reasonable explanation may result in my suspension from any future Free Intellectual Property Consultation Service.
  • If a situation of actual or potential conflict of interest arises during the consultation, the Advisor may terminate the free consultation session.
  • No written analysis or suggestion will be provided by the Advisor and recording by whatever means (except written notes taken by me) during the consultation session is strictly prohibited.
    Notes of Application: IPD reserves the right to make a final decision on the following issues :
    • whether or not to accept your appointment request; and
    • arrangements relating to the Free Intellectual Property Consultation Service session with the Advisor.
    Please note that the provision of personal data is voluntary but failure to provide such data may result in the delay or suspension of processing your application and/or prevent the Intellectual Property Department (IPD) to further communicate with you using the contact information stated in Part I above. IPD is committed to ensuring that all personal data provided under this application are handled in accordance with the relevant provisions of the Personal Data (Privacy) Ordinance.
    Personal Data Collection Statement: Purpose of Collection: The personal data provided will be used for processing your application and if accepted, future correspondence in relation to promotional activities for IP protection and/or IP trading whether organised by IPD solely or in conjunction with any third parties.

    Transfer of Personal Data: The personal data collected will be kept in confidence, however, they may be disclosed to other Government departments, organisations and service contractors that are directly involved in the promotion of such activities for the purposes of collection above mentioned.

    Access to/Correction of Personal Data: In accordance with the Personal Data (Privacy) Ordinance, you have the right to request access to and correct the personal data provided. Requests should be made in writing to the Personal Data (Privacy) Officer of the IPD.
