To qualify for the making of a grant, you must have given the Registrar of Plant Variety Rights all reproductive material of the variety concerned as requested by the Registrar, and the Registrar –

  1. has approved for that variety a denomination proposed by the applicant;
  2. is satisfied that you are the owner of that variety;
  3. has received the prescribed fee; and
  4. is satisfied that that variety is new, distinct, stable, and homogenous.

An application to register a new plant variety right must be made to the Office of the Registrar of Plant Variety Rights of the Agriculture, Fisheries and Conservation Department of the Government of the Hong Kong SAR.  For more information on the application for plant variety protection, you may visit here.

The grant of a plant variety right in Hong Kong is only valid in Hong Kong.  To obtain protection outside Hong Kong, you must make separate applications to the appropriate authorities in those jurisdictions.
